These Terms and Conditions govern your use of the Silent Modz store operated by Silent Mines Inc., doing business as Silent Modz. By using the store or placing an order, you agree to these terms.
Eligibility and Store Use
You must have the legal capacity to enter a binding agreement or use the store with the involvement of a parent or legal guardian. You agree to provide accurate information, use the site lawfully, and not interfere with its security, checkout, availability, or other users.
Products and Orders
Product colors and appearance may vary by screen. Availability can change. An order confirmation acknowledges receipt but does not guarantee acceptance. We may cancel and refund an order affected by inventory or pricing errors, suspected fraud, payment failure, shipping restrictions, or an inability to fulfill.
Stocked and made-to-order controllers are normally processed the same business day or within 24 hours, Monday through Friday, excluding holidays. This is a processing estimate, not a delivery guarantee.
Pricing, Payment, and Cancellation
Prices are in U.S. dollars unless stated otherwise. Taxes, duties, and available shipping methods are calculated or disclosed during checkout. Payment authorization is required before fulfillment.
Cancellation requests must be submitted within 24 hours of ordering. Because processing may begin immediately, cancellation cannot be guaranteed after an order has shipped or entered irreversible customization. Contact support as soon as possible.
Shipping
We use carriers including UPS, USPS, and DHL. Shipping estimates are not guarantees. Free standard shipping applies to eligible domestic orders with a product subtotal of at least $149.99 before discounts. International options are limited to destinations available at checkout, and the customer is responsible for duties, import taxes, and local fees.
Report lost, stolen, damaged, or returned-to-sender packages promptly. Eligible packages confirmed lost or damaged will be refunded. A carrier scan marked delivered is not automatically eligible for a refund; we may require a carrier investigation and supporting information.
Returns and Warranty
Return, refund, and warranty eligibility is governed by the Returns and Warranty Policy, which is incorporated into these terms.
Intellectual Property and Third-Party Marks
Silent Modz site content, original graphics, branding, and custom presentation may not be copied or commercially reused without permission. Third-party product and company names, including console-platform marks, belong to their respective owners and do not imply endorsement unless expressly stated.
Disclaimers and Limitation of Liability
To the maximum extent permitted by law, the site and its content are provided on an “as available” basis. Silent Modz is not liable for indirect, incidental, special, or consequential damages. Our aggregate liability arising from a product or order will not exceed the amount paid for that product or order. These limits do not exclude rights or remedies that cannot lawfully be excluded.
Governing Law
These terms are governed by the laws of the State of Ohio, without regard to conflict-of-law rules. Any dispute will be brought in an appropriate state or federal court located in Ohio, unless applicable law requires another forum.
